Terms and Conditions: Donations

These Terms set out the terms and conditions (the “Terms”) which apply when you make a donation to Heriot-Watt University ("us" or "we" or "HWU" or “our”) using the website at http://www.panmurehouse.org/ (as updated from time to time) (the “Website”).

  1. About Us
    • We are Heriot-Watt University, a company established by Royal Charter in the UK with registration number RC000216 and a charity registered in Scotland with charity number SC000278, whose registered address is Lord Balerno Building, Edinburgh Campus, Edinburgh, Scotland, EH14 4AS, UK. Our registered VAT number is: 270 8005 79.  You can contact us using the details set out at paragraph 8.5.
    • We are a charity and any donation which you make using the Website will be used by us at our sole discretion within the scope of our charitable purposes.
  2. agreement to the terms
    • By using the Website to make a donation you are indicating your agreement to be bound by these Terms. If you do not wish to be bound by these Terms then you should not use the Website to make a donation.
    • The contract between you and us shall for the donation is made up of these Terms and the Website Terms and Conditions (the “Contract”). In the event of conflict between these Terms and the Website Terms and Conditions then these Terms shall prevail.
  3. making donations
    • You can make donations to us by following the instructions on the Website.
    • When you donate through the Website and confirm that you are a UK taxpayer in accordance with the requirements of the Gift Aid scheme then we will reclaim Gift Aid on the donation. It is your responsibility to determine whether you are eligible for the Gift Aid scheme and you are recommended to seek independent tax advice if you are unsure. 
    • When making a donation, you confirm that the information provided by you is true, accurate and complete. It may be necessary for us or our payment processor to verify your identity or details which you have provided and you agree to provide such information or documents as may be reasonably requested by us or our payment processor.  If we are unable to accept your donation, we will inform you of this.
    • If you use a payment card to make the donation then you must be the authorised user of the card and have permission and the funds to make the donation.
    • Once a donation is made then it is final except where such donation is as a result of fraud. In the event of fraud, we will refund the amount of the donation back to the card holder provided that (a) the request is made to us by the card holder within 14 days of the fraudulent transaction, and (b) the fraud has been reported by the card holder to the relevant card operator.
  4. DATA PROTECTION NOTICE
    • We will process personal data that you provide to us or which we collect about you in accordance with the Privacy Notice. 
    • We may disclose personal data to third parties as set out in our Privacy Notice.
    • Please inform us promptly of any change of personal information you have provided to us.
  5. liability
    • We will not be responsible for any failure where this is due to:
      • events outside our reasonable control;
      • incorrect details provided by you;
      • issues with your card or payment provider; or
      • technical issues with your data connection or devices.
    • Nothing in these Terms shall limit our liability to you for fraud or wilful default or for death or personal injury caused by our negligence or where it would be unlawful to do so.
    • In all cases our liability to you in connection with these Terms will not exceed the donation made by you.
  6. ComplaintS
    • If you have any complaints then you can raise these with us by contacting us at the address in paragraph 7.
  7. general
      • If we make any changes to these Terms these will be published on the Website.
      • If we fail to insist that you perform any of your obligations under these Terms, or do not enforce our rights or delay in doing so, that will not mean that we have waived our rights or that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.
      • Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them or parts thereof are unlawful, the remaining paragraphs and (where applicable) the parts thereof will remain in full force and effect.
      • The Contract is between you and us only. No other person shall have any rights to enforce it.

  • You confirm that you have read these Terms and the Website Terms and Conditions carefully before agreeing to be bound by them.
  • Any dispute or claim arising out of or in connection with this Contract or its subject matter or formation (including non-contractual disputes or claims) will be governed by and interpreted in accordance with the laws of Scotland. Disputes or claims will be subject to the exclusive jurisdiction of the Scottish courts.
